I got is renewed in Chicago in 7 days, i was shocked when i received the mail, i thgt it has come back for some error , but it was the new PP.

that the current application processing range is 6-10 months after filing. Given the current economic conditions, it would be beneficial to see the application approved rather than worry about delays.

My wife got her H1b petition approved but not the change of status, that is she did not get the I94 along with the approval (she was outside the country at the time of approval). I know that she should be going out of the country and get the visa before she can start working. But After some research I found that there is another option, which is filing "amendment petition".
Has anyone done this before. If anyone has done this please share your experiences.
Does she has any H1 visa stamped in her passport?

Hi Everyone,
My labor was approved under EB2 in Sept 06 under perm. Filing date was May 06. However my employer just told me that the letter has come from DOL to run the advt for the old labor that was filed under Eb2 category in Feb 05. I save a year plus on the old labor. Can I use that labor and if not what happens to that labor?

Anyone, who has renewed their passport at CGI houston very recently, please post response time and dates. Mine was mailed on 16/6/2008 and received at the consulate on 18/6/2008. No response till now. Thanks in advance for your replies.
I recently got mine renewed at Houston. It was done via Fedex and not personal appearance/visit. Applied on April 14th and received it at home on June 24th. So about ~10 weeks. You wouldn't get any response. No point calling the number - we can't leave a voicemail too as mailbox is full! However, I sent them couple of emails on 19th June and 23rd June and voila they sent me my new passport on June 24th. I guess they were waiting for my emails ;) don't worry you'll get urs soon.

I wanted to share my success story of getting I-485s re-opened with the help of IV last week. Let me start with the end result first and those interested in details could read further!
Synopsis
After 4 months wait since the wrongful denial of our 485s, I contacted Immigration Voice (IV) core team for help on April 25, 2011 as a last resort. On the next day morning (April 26th), I received a phone call from USCIS Headquarters in D.C. and the officer informed that Service Center approved my MTR and reopened 485s, and I should receive system updates in a day. At the end of the day, I got email updates confirming re-opening of 485s. It was an incredible moment in my life to receive a call from USCIS about my case. I am very grateful to the IV leadership and its deep relationships within USCIS and DHS. Prior to contacting IV, I filed an expedite request with USCIS, contacted Ombudsman, and contacted my Senator as well. I received standard responses but no positive result. Adding fuel to the fire, my EAD was due to expire in July 2011.
At the end, even though I never anticipated issues with my 485, I was very happy to see that my active participation with IV�s advocacy efforts over the last few years opened up several options for me to seek help.
Prologue
During the middle of last year my attorney moved their offices and we filed a new G-28 for address change. After couple of months of this address change, during early Nov�2010 USCIS apparently sent a NOID asking for AC21 employment letter to the old address of the attorney. USCIS did not send text or email even though both me and my attorney subscribed to the notifications. USCIS did not even send a copy of this notice to me. After 30 days of original notice, USCIS updated their system that their mail was returned. This was the first time we came to know about the outstanding notice from USCIS. We immediately contacted USCIS and requested for a copy of NOID. In the meantime, 33 days elapsed, and USCIS promptly denied I-485s of me and my family. I have been working on EAD and it was due to expire in July 2011.
Life after denials
I requested my company for AC21 letter and after receiving the employment letter, my attorney filed I-290B MTR around the end of Dec�2011. I continued to work as usual using my EAD. After couple of months of waiting, I requested USCIS to expedite. Their response was to wait 30 days. Nothing happened. Then, I simultaneously contacted my Senator�s office and Ombudsman. I promptly received responses that they would look into this and I should expect a response from USCIS within 15 days. Based on these responses, I should have received approval by the first week of April. Again, nothing happened until the 3rd week of April. I was becoming wary of my EAD expiry and applying for renewal within 90 days of expiry.
IV�s Advocacy Days in D.C.
I have been a donor for the last few years and actively participated in advocacy days of 2010 and 2011. During this year�s advocacy event, I met IV core team and explained my case. Based on their advice, I waited to see if USCIS responds by mid of April. After long wait and exhausting all options, I requested help from IV. As I mentioned, within 24 hours, I got the approval of MTR and our status was restored!
Though not everyone gets into this kind of trouble, it is very heartening to note that there is someone (IV) behind us to help when in need.
Final Request to Readers:
As someone who associated with IV for the last few years and after going through this ordeal with USCIS, I recommend all those waiting in line or waiting to be in line (for GC) to start associating with IV. Looking at the Approval trend, it looks like TSC and NSC are not following the FIFO (Based on PD, ND etc) when approval. More than half of the approvals are after my PD.
Any one has any idea of approximately many EB2-I cases were approved last year in Sept 2008. Because of the out of turn approvals random date approvals I may be loosing chance once again this time.
I had RFE's for my wife's and my I485 way back in March 09 and after we replied to the RFE's and there multiple LUD's and Soft LUD's till 04/14/2009. On 04/04/2009 last Soft LUD was on my Wife's , Daughter (she never got any RFE) and my case and since then no updates. I was assuming that my case is PreAdjudicated and had high hopes.
Once again seeing an inefficient and irresponsible USCIS being unfair...

Called my local congressman's office and left a voice message. Called the offices of Bob Menendez and Henry Cuellar. Rep. Menendez's staff noted down my message and said they will pass it on. Rep. Cuellar's staff mentioned that some of the contents of the bills are contradictory to the things that he supports and got into talking about comprehensive reform. I politely listened to him and reiterated my request, mentioning that his support was very important to get moving on immigration reform. Have to call the other members now. Seemed quite daunting initially However I will try to finish calling the other members as well. Do we still call the office of Ciro Rodriguez ? Going by the postings, they seem to be against the bills.

If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. I totally agree that firms like these which abuse the system ought to be severely punished and blacklisted, so that geniunine US companies can get their required workers , when they need them . The staffer asked me where I am calling from. Then said you are not a constituent of the congressman and was not willing to transfer to the person who handles immigration issues. I insisted on leaving a message and he took the message, but was surprised, did anybody else encounter this? How do we handle this if it happens with other congressmen?

The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Please contribute and incrase the membership of IV for the good of all of us.
