Can my current company continue my GC even if I transfer my h1 and join another company?
Priority date - May 2007
I-140 Approved - Jun 2008
Waiting for date to be current to file I485 and my current company is ready to continue the GC process even if I transfer my H1 to another company.
Your expert advise will really be a help for me to take decision on this , is it wise to change h1 now?

Your change of status will come under 65K cap..and if the cap is not increased (lets still hope for the best) then it's going to be lottery again and it's your luck to be selected in the lottery. because of lottery you can not plan a lot of things..

No, my new would be employer will not be doing H1 transfer for me. They will take the EAD route. Yes, I know the start and end date of EAD as that is printed in the approval letter.
So, I guess, although I don't have the plastic card in hand, I can start processing AC21 on the basis of EAD approval notice and A#, that gives me 90 more days.
I will read I 9 more carefully with time. Also started upgrading profile.

I do not have personal experience with Fragomen; however I have heard that it is the large immigration law firm in the country.
The only problem (as far as I know) with them is that your PERM WILL be audited (according to DOL memo). This may lead to delays (and god only knows how long...)
Most people on this forum know this fact; I mentioned it as you appear to be the novice player...

That's the most surprising part:-).
Probably they need to validate my H4(my current status in US) based on his
H1 validity.
But thank God,my woes r over now,as I got my approval today.
But the applying for SSN woes r going to begin soon.

I think even the local govenment is under the H1b quota. Therefore, I had to apply for the H1B in the next year.
The DOL online prevailing wage only shows that the salary for that position is for the county. The offer of the town govenment is $5000 lower than the prevailing wage of the county. And they can not increase the salary because the town is not near the rich area in the county. They told me the salary they offer is the highest for this position.

Get the DOL report before u take up the job. DOL will give the estimation for salary....!!!Use it and ask u r company attorney to file for the H1b now its self mentioning the start date as future date (when u r opt expires). There is nothing called "H1b transfer" basically every company applies new H1b but it is within quota and you can have multiple companies holding your h1b visa but you can work only for one company on full time rest part time and there is no need cancel H1b, just go and join the company you want to join. Hope this helps

Hi,
I am looking to switch employers. Although the job descriptions are pretty similar ( C coding, design, protocols etc.), my PERM was filed for Computer Software Engineer-Applications whereas the new one falls under Computer Software Engineer, Systems Software. Is this a risk during I-485 adjudication. Also my new salary is 50% higher than my original PERM salary (It has been almost 4 years since my original PERM).

Can some one please shed some light on this May 15, 2005 cut off date and its significance ? Does it affect folks who have already filed for labor and I-140 after this date and have got it approved .... say sometime in 2006 ?

Why would one get a LUD on an OLD h1 with no LUD on anything else?
Just got CRIS email/LUD (no status change) on an old h1b that had no status change since Oct 2004. No LUD on the I140/485 or anything else. Only thing that makes sense to me is that my H1b is about to expire on dec 10 so maybe it has to do with that?
Anyone else have a similar experience. it's a little nerve wrecking.
Even I had a soft LUD on my old H1 which was expired and was approved way back in May 2004.

IRS can also FAX the tax forms and W-2's but they do not have that information for the latest tax year. This means that they will not be able to provide you with the 2006 tax return. Also, my lawyer asked me for W2's of past 3 years. Both my husband (since he is on H1 too) and I had to provide W2's of 2004, 2005 and 2006

Am assuming that in this case clarify has to get his part time employer to file for a NEW h1, which ofcourse means he is under the h1b quota, which was exhausted on the first day they started accepting it for 2008.
So I guess clarify is better off with his EAD.

Receipting update is just a reference.
My applications reached NSC 6 months ago on July 9th.
I have no receipts and checks were not cashed.
As per IO's my name is not in the system.

Because you never know, when the new fiscal year begin on Oct 08 for the USCIS the EB2 dates may go back to Mid 2003 and it will not quickly move forward until July or Aug of 09.
