Thanks for the reply , let me file the H1 transfer with Employer2 now in "Premium route" with the I-140 approval from Employer1 and see if we get a approval. Once i get a approval , i think stamping it wont be an issue after 7-8 months even thought Employer1 has revoked that I-140 ?

However i want to clear even if the Employer1 revokes this I-140 my PD still remains locked - right ???

    >> if my I-140 gets revoked can i switch to another employer and extend my H1B by 3 more years ??
No, I-140 must be active in order to extend H1-B beyond 6 years.

no-it is something else....attitude of positive expectancy... ;)

often times i have noticed that the blissfully ignorant GC applicants come better off than rest of us- who act like chicken with the head cut off after every bad news!!! may be they dont worry too much and look at it from a whole another perspective...who knows...i wish i could be one of those, but i am too far in the game...damage is already done...:D

Yep, It is luck nothing else...

USCIS memo dated Jun 12 2008 says

I filed my Form I-765 more than 90 days ago and I have not received a decision, who should I contact?
If you have not received a decision within 90 days of the USCIS receipt date and you have properly filed your EAD application, you may apply to obtain an interim EAD by appearing in person at your local USCIS District Office. You must bring proof of identity and any notices that you have received from USCIS in connection with your application for employment authorization.

Mine expires OCT 3rd. Applied Jul 3rd, FP Jul 31st. No LUD , No News since

If this is true, it is really scary for people who are solely on EAD and no longer hold H1 status.

It's true, here is the link:
    http://www.nafsa.org/_/Document/_/uscis_consolidated_guidance.pdf

    read example on page 10.

Same with me too. My application was moved from NSC to TSC and has been lying there since then. Hasn't been assigned to an officer yet:mad:

I never had any RFE, but my case has been bounced around for no reason. From TSC->CSC->TSC and I am told that it is not even pre-adjudicated not even assigned to any officer as yet. I have yet to see any more illogical organization other than USCIS.

[FONT="Microsoft Sans Serif"]From numerous visits to USCIS facilities, the Ombudsman has observed that adjudicators prefer to work on the cases that are easiest to complete. Adjudicators pick the low hanging fruit first because supervisors base performance evaluations on the number of cases completed. Consequently, adjudicators put aside the most difficult and time-intensive cases. These cases remain pending, perhaps for years, while backlog reduction appears generally to be succeeding.

Is there any information on what an "easy" case is?

I'm sorry for posting my question here. I know its not a right thread for my posting but I don't find any link for new thread.

I'm a July 2007, I-485 filer with PD dec 2004 EB3. I have been working as sr.project engineer for the past 4 years with an MI based company. At present my company is not doing good business started downsizing. i don't know when I'll be victimized. So, I have started searching for new jobs vigorously and got an offer for Designer position ( Permanent position with all benefits) with slight increase of pay. I don't have to use my EAD as employer is willing to transfer my H1B which is valid till 2010. Friends my question is -

There is a degrade in position, Does it effect my Gc process? I know, no one will be in this type of situation. my heart bleeds to accept the lower level position but, the fear of going out of job with wife and two kids is forcing me to accept the offer... If it doesn't effect my GC process..

    hopein07,
Financial planners reccommend term because one would need the coverage until a major mile stone in life is reached - paying off home mortgage, children completing college education, etc.
    .

You should have life insurance till your last breath so you could pass huge wealth to your heir for little amount like 1million for $100/month at 60s or 70s of your age

well there will always be certain exceptions everywhere....Michael Aytes did mention it publicly when he testified before congress in his document below

    http://www.uscis.gov/files/article/I...as_30Apr08.pdf

he does mention that all these applications will be pre-adjudicated just short of visa number. So officially in my opinion they will not go back to these applications unless there is an exceptional condition which makes them do it. I can safely say that broadly it's not gonna happen.

I think once the application is pre-adjudicated...that's it!! I don't believe USCIS will spend anymore time and resources to these applications again...until a visa number is available from DOS and they apply the number to the pre-adjudicated application....my 2 cents! I agree with what you say BUT they may open the file again (to verify certain things and not just assign it a visa) once the visa number is available (I guess that is what you are trying to say) ..is that right ?
BTW - I have not read the memo in detail ...it is a waste of time
I guess the 64,000 dollar question is - how to find out if your case is pre-adjudicated ?
in summary - it is a big big muddy and dirty mess ..no wonder the right word is that the system is broken and very less immediate hope for EB-India / China

Couldnt agree with you more - absolute magic from ghalib

Actually, the lyrics are from Shahryar.
    http://en.wikipedia.org/wiki/Akhlaq_Mohammed_Khan_'Shahryar'

Just wanted to give the credit to the right guy. Most ppl think of only Ghalib when it comes to Urdu poetry. There are many others too.

And of course, Khayyam's music and Asha's haunting voice contributed to magic too.

Not that it does much good since it doesn't really mean much..

Didn't want to start a new thread for this.

We know it does not mean anything and may even simply be lies, we still anxiously wait for it, hoping miracles happen, day after day, week after week, year after year... :-)

I oppose the Senate immigration deal in current form.

Immigration Reform unfair to the legal high-skilled. Legal First

We are always told, Break the law, and you will be in trouble. But, the recent Immigration Reform Grand bargain proposes to send a message that is precisely the opposite.

We are being told that no undocumented immigrant will get ahead of those in backlog. While the backlog of Family-based petitions has been highly publicized, the petitions of individuals (engineers, scientists, doctors and other professionals) are being left in legal and bureaucratic limbo. About half-a-million highly qualified professionals and their families have put their faith in the legal immigration system and due process of the United States, while working to enhance the US economy. These people have pending petitions either with the Department of Labor, or with the CIS, the final adjudication of which will enable them to work with a US employer, with consequent ripple effect on the US economy.

In the old system, employment-based petitions were limited to 140,000 per year, but the proposed system, in order to reduce backlog, reduces them to 90,000 per year only! On the contrary, Family-based cases used to be limited to similar numbers, but now have been increased to 567,000 per year! In addition, close to100,000 of these applicants with pending petitions are being asked to start from scratch in the new system. In effect, it is similar to changing the rules or rather, the Laws after the fact! Innocent high-skilled prospective immigrants are being penalized due to bureaucratic delay in the DOL.

Highly skilled doctors, scientists, engineers, and computer professionals have been stuck in backlogs since the last 3-4 years. They had hoped to get relief from the Immigration Reform, but have been let down badly. They are being forced to renew their H-1Bs yearly now, while the old system allowed 3-yr incremental renewals while their Green Card petition was pending. Seems like a fitting reward for following the Laws, isnt it?

Per washintonpost report, USCIS on purpose delays the process and keep backlog to earn the extension and renewal fee as 20% of their budget. THIS IS CALLED SCAM.

Your attention and help requested on the matter.
