Could you elaborate on the harm that would cause us please...
I would like to understand this system.....
You have to understand country caps for that.
Today, the law states that:
Give 7% of 140,000 visas(annual quota) to each country. After that, if there is leftover visas, it can go to countries that need more than 7% of 140,000. Today, India and China are only 2 countries that need more than 7% of 140,000. Eventually, each year, India and China get a lot more than 7% of 140,000.
If you change the law to remove the clause that says "you can allocate leftover visas to over-subscribed countries", then India and China would be severly affected and the leftover cannot be used by them. It would either be unused (wasted) or flow downwards to EB5 or family based.
last year, the hard cap gave a big headache to us for 2 months. Then thru Immigration Voice's efforts, Sen Brownback proposed an amendment to remove the country cap and allow 485 filing when visa numbers are not available.
Brownback's amendment was folded into the last minute manager's amendment(Sen Specter was manager of Senate CIR by the virtue of him being the chairman of Sen Judiciary committee). And we got rid of the hard country cap that would have been created by CIR.

I thought, 15000 members was a small goal. But I guess we have to start with even smaller goals. I agree with Amit.
There's too much at stake to give up this campaign. Without membership, we are a weak bunch. To fight organized campaigns by groups such as Numbersusa we need the member strength.
Let us aim for 8000 members by Jan 15th. Current membership stands at 7919. We need just 80 members to reach the 8000 mark. If 10% of the current membership brings ONE member by Jan 15th, we can easily reach that target. With 300000 immigrants in this kind of quagmire, cant we get 80 people? I believe we can.

Use spill over visa to give GC based on PD not on country specific. It will solve the backlog in 2 uears. Right now EB2 I and C getting spill over from EB1 as well from EB2 ROW.
This is not fair for EB3.

Already because of the categorization (country based limit) we have such a big queue...Why further categorize each country as EB1/2/3..etc.? ....As you aptly mentioned most of EB2 & EB3 guys do the same job...but the employer decides whether it is EB2 or EB3, even though many have masters degree and more than 5 years experience.

My experience with CGI houston was after waiting on call for 1 hr in queue with counting down my position in queue, IVR informed me that "No one is available to answer my call press 0 for operator" , this goes in loop. I never was able to speak to a person any time during my passport was with CGI houston.
My advise if you are dealing with CGI houston is Send your passport and forget about month or so you will receive renewal after month.

gc4me : Pardon me, but how is citizenship not a relevant issue to legal immigrants? If you're not worried about citizenship issues, then why are you even infesting this thread? Many people, including me, might be interested. And I have indeed contributed, although I don't see how that is any of your business and as long as this website isn't being hosted on your home computer, I don't see what gives you the right to ask it of anyone in a patronizing tone. Now this GC thing is so screwed up, we might want to include citizen ship issue as well but definitely, at the very lowest priority.

May be we can also try to reduce the retirement benefit age from 65 (or may be 67, or 70 I really don't know, whatever it is) 60. That will be tremendous help for early retirement. What do you say Mr/Mrs. Saralayar?

I have contacted congressmen and senators to try to highlight this issue and to be totally honest most of them have so little knowledge of immigration law they do not even understand the problem.
The CIS do not care, they follow the rules.
It is attention much higher up that is needed on Capitol Hill and someone who is willing to make it a REAL issue.

Yes it kind of feels that way. And see the history - in 2007 CIR they wanted to reduce annual visas for employment categories. Slowly they start adding more tidbits for legals to get things passed. There is still a disadvantage for new H1s, L1s.
What if we do it the other way around? Grant immediate GC to all waiting on EB visas. Subject all illegals to probation rules till they are all validated by the FBI in 10 years. currently illegals identified are sent to detention, and some are put on electronic monitoring.
Let them compete with American citizen labor at American wage levels determined by the govt. Similar to how H1b wage is determined.

We should also try to get our bill added to DREAM, as an alternate The army would like it, as DREAM provides a path for illegals to join them to get legal status.

I actually agree with logiclife. Your worth = how you perform. I have a Ph.D. and I am a post-doc in a lab, but my salary depends on how I perform. If someone with 6 months of NIIT can do what the job needs great. But, and this is a big but, whether you like it or not, US immigration policy is going to favor those who got degrees from the US . So Ron Hiras will have their way, and something will be worked out for those with US degrees. IEEE has tons of "well-respected" studies which prove that graduate studies improve the person's worth for an organization. Brb2 is also perfectly correct in that they fit in better in the US work culture, and hence have what the US industry needs. It is also true that if the need arises, those with US degrees can find employment with non-consulting firms; most non-US educated people however need these desi consultants.
It is false. US employers need good skilled workers. The only way they used to get people in earlier days was through students who come and graduate. But after the body shopping infracture was built, they started getting people through body shops.

As per super specialization in US degrees, and Phds etc...It is true that some jobs need these skills and these kind of jobs are always available to people with those skills.
But most IT jobs at an entry level or a junior or a mid level programmer does not require that you have a US degree or a Masters or a Phd, and these are the kind of jobs that get filled by H1bs without US Master's.
In fact if a job requires a Phd and if they did not find a qualified US worker for that job, the job will be open for a PhD as long as the degree from a foreign univ gets evaluated and candidate is good.
In the days where there was no body shopping infrastructure was not there, businesses were forced to take MS grads from US univs just because they were accessible and tghere was no concept of outsourcing.

My employer will not sponsor me for no particular reason and all the horror stories about GC processing have discouraged me from pursuing it on my own. E-filed EAD renewals for self and spouse on May 5 with Texas Service Center. Supporting documentation received by TSC on May 12. Card Production Ordered email received for spouse's renewal on May 14. Seems rather quick! No biometrics appointment received this time. Wondering if my approval will also follow soon. Also wondering if renewal period will be counted from expiration date of current EAD (current EAD expires Aug 24, 2010).
Same thing happened to me too, EFiled on May 21st. Haven't sent any photos and No Biometrics, but on May 12th the status says card production ordered. Hope its not a system failure about the statuses.

9 years oh my god... I read on one of these threads(May be threads for US students), a person is waiting since 2002. He has done his PHD from here and has children in colleges.
He went to extend his visa stamp to india, and they refused becuase the consulate asked him to wait till a decision on his case is made, then upon that decision they will give him a visa or not.
As per Pappu this is the only year... We have to do it this time by hook or my crook. All our provision should be met.
1) People waiting with I-485 get more visas to get GC.
2) People waiting to apply for I-485 should be allowed.
3) People should have the AC21 portability available so that they can leave their desi companies that torture them.
4) People with Master's Degree should also get priveledge.
5) Let their dream be fullfilled too (Increase in H1-B :D )

Last month (July 17) I e-filed EAD and AP for both me and my wife. My wife's AP got approved couple of days back.
I was looking at the receipt notices and observed that the priority date is missing on the notices. Observed the same issue with my 485 receipt too.
Does anyone else have the same issue? Is that a problem?

Even though its anticipated that EB3-I is screwed up for ever , I expected at least a snail movement instead its U for the whole of year. More of these days... I think we are all spending more time debating options.. We will go no where with waiting...
I think last year they did around 3000 odd applications for even at this rate it takes 30+ years and there is no relief in sight...
We have spent enough time already in thinking about ways... ONLY one way that works is some kind of legislative relief.. IV Core knows about it... These days every time i meet a friend or relative I have only one Message please join IV and contribute and if you dont want to contribute atleast please participate in any initiatives that IV Core might recommend.
I am in for the best i could do as we did in CIR 2007.
