i thought we were supporting point based immigration to happen like in european countries and canada

Kennedy's staff picked up something from their old files...like the original McCain-Kennedy bill of 2005 (the CIR before it hit the judiciary committee last year) that had the hard country cap and slapped it on Thomas against Session's amendment.
If you look at the text, its remarkably similar to the original McCain-Kennedy text (140K to 290K, hard country cap, recapture...all that. Even the description of the title).

At least EB3 I should get its share of Visas, which is not happening. A lot of the visas are being wasted or spilled over to other categories.
Actually, this is really insane logic. If there is any spill over from EB1, it should go to most affected categories like EB3I. But its going to EB2. This is a BS.
At least the following should happen:
1. EB3I should get its share of allocated visas every month / year.
2. Spillover should happen to EB3I (as a most trafficked category)
3. Consider the EB2 porting while setting cut off dates.

Conference committee and its proceedings are always closed-door things. Remember there is alittle one can do. also considering the gravity of the situation, i'd say just wait. i know that's not the best scenario but it is what it is
i don't think the committee not yet formed, in the first place and there is no time line / rule that guides about conference committe proceedings

If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. I totally agree that firms like these which abuse the system ought to be severely punished and blacklisted, so that geniunine US companies can get their required workers , when they need them . I just got my wife's h4 approval letter today but the I-94 does not have any validity period on it, its blank?? Moreover, We received two more i539 approval notices sames as my wifes without any validity period under my wife's name (Applicant)... beneficiary were for two kids age 9,11 totally different last names/Nationality :confused:
I will call them tomorrow, I was wondering if anyone else also had this experience, do we have to travel outside the country to get I-94 stamped? my H1B approval has not arrived yet but the status online says approved. Our old I-94 on the passport have already expired, will that be problem?

Now this is what is going to happen.
Because DOS and USCIS screwed up big time playing loosely with laws and expecting no reprisals for their actions, they will now beg/borrow for the lost visa numbers and make them available for July filers.
I see no escape route for the mess up. Rice, who did not pay any attention to this fisco gave her on the lip casual response to MSNBC reporter.
It looks like this issue is bigger than Iraq from security stand point of view and also with latest information of Al-Qaeda making statements to get into US for attacks.

- unless you have an account big enough to buy a mercedes SL500 , it is so not worth the time

- u can do ur taxes urself, no need for a tax consultant.. just use hrblock/ turbotax. make note of ur trades in a spreadsheet.

- now is not a good time to enter the market... will it go up? .. i don't know.. will it go down? .. i don't know. But the warning comes from volatility... it will shake you out.

let me take a guess - at the minimum - 2 years for your PD and 4-5 years for my PD.
I am quite confused. My date is June 2002 first week .
Not sure if it makes sense to Port to Eb2 , but big uknown is how long it would take PD to move up to June 2002.

Here is what my attorney said.
"Completely false rumor. Legally impossible for retrogression to occur prior to Aug. 1. You'll be getting a Breaking News from us on it today or tomorrow."
Wish the statement from your attorney is true and we all will be able to file 485 through the month of July with no issue. I'm luckly to get the paper work done and ship the package to Attorney and waiting on their action, But have few friends who could get Medical Appointment only around second/third week of July. Also this EW Other Worker Quota that became unavailable and also rejection of these applications has made us worry a lot, although it is a diffferent category we are at fear that this could happen to us. Reading the VB again, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002... So this category has only 5000 Visas and I'm not surprised this bacame unavailable and think this category is far more crowded than others... We should be fine atleast in July... May be too optimistic... but nothing wrong in hoping for the best and wish all the members can file asap.

My wife and I went for the medical examination 1.5 years ago, when we thought we'll be eligible to file shortly. We still have those sealed envelopes. However, the time passed and I understand we need to undergo the exam again for our June filing, correct?
The first time around my wife had a positive skin test (immunized in childhood) and negative Xray. Back then she was advised to never do the skin test again, as it'll always be positive. So, she'll need to go for an Xray this time. However, she is pregnant, and they don't Xray pregnant women... Is she an exempt then? There gotta be a provision for something like this, right?

Hi..
my H1 got approved on dec 2006 for 2007 cap.It is 3 years valid.
Because of some problems between me and my employer,
i just transfered my h1 to h4 to maintain my case status on jan 2007.
He didn't give my H1 paper to me and gave me a copy of it.
Now,Can I reuse my H1 again?
and
If it is posible , can transfer the same h1 with other company without paystubs.Please help me out.

Each Passport is unique and will have different number each time they issue.. Just staple all your passports together and carry with you for travel.

Green card is almost invisible for Highly skilled immigrants from India, China, Philippines and several other countries residents, because of backlogs, country quotas, FBI name check delays, Labor Certification delays and backlogs etc. (Some of these words may be new to you. )
Employment based green card for highly skilled immigrant fall in EB-1, EB-2 and Eb-3 categories. Even if you have PhD and university job , you do not qualify for EB-1.
and that is only open category. For Eb-1 you need tenure track appointment at University with several years of experience, around 20 research papers and several international awards etc. Those who apply for Eb-2 or EB-3 or NIW ( national interest Wavier) should not hope for green card in next five years under current situation
This excellent group of people comprising of many bright people from India, China and many other countries around world, is very active in Washington D.C to change the above situation in our favor. Though it was formed in 2006 only it has around 10,000 members. All of them are fighting for our green card.
I urge you to take look at their website. I am sure you will be impressed by the work they have done in last one year for highly skilled immigrants. They have already established strong political contacts and are using lobbyist to pursuer changes in laws in our favor.
