Yes, there is no point in re-filing,rather it will create confusion. I spoke to USCIS ,at this point the fedex receipt no. is good enough ,to prve that your application reached service center,before 17th august . Now it makes sense to just wait for the receipt.

Hi,
I have got a job offer & this employer has few pre-approved labors which he offered me if I join him.
I am on H1B visa since 3.5+ years & I am looking for the company to get my GC as soon as possible. I have BS + 10 years of IT experience in India/ USA/ UK, as Software Engineer/ Solution Architect / Project Lead/ Project Manager / Sr. PM etc.
I want to know :
1. Is it possible to use this pre-approved labor for me... if I have all matching skills & experiences to show in my resume (experiences/skills gained before that approval date of that labor)...? This approved labor shows the name of their previous consultant.
2. Is it necessary to file the labor substitution by the employer...if I want to use that approved labor...?
3. Is it possible for this employer to directly file my I-140 against this approved labor...?
4. What are the info/proofs to verify that this employer is really filling my I-140 against this labor... ? (This employer has their attorney & I could not have better communication with their attorney)
5. This employer is a consulting company...(desi) & they asked me to sign a financial agreement to repay their expenses on labor substitution/I-140/I-485...if I will leave them early. ...Is it legal to ask for such kind of agreement...?

Hi, you need lawyer for your first 3 questions. For question 4, you need to ask for copies of 140 petition and 485 petition and labor substitution. If you cannot be strong and ask for it, and take their word, then you will constantly live in doubt and it will be really really bad. Negotiate with them that you will need copies of everything that goes into USCIS and comes out of USCIS and you want your own attorney to handle all that. Otherwise its not worth it. You will put yourself in vulnerable situation without your own attorney doing all the work. If you choose to trust them now, and go along with it(their lawyer, their control), 6 months from now you will be in a worse situation than most of the other guys here who are stuck in 3-4 years of retrogression. Dont ask me how, trust me on this one. I know the tactics and methods of such employers very very very well.
For questions 5, I think its legal for employers to ask employees to pay for USCIS fees and lawyers fee if the employee quits before GC is approved.
Other than that, you will find a lot of hatred from this forum as what you are doing is very much inflaming since you are cutting in line -- legally so -- but still, its cutting in line. So dont be surprised by that.
Good luck and make sure you get your own lawyer(that your are paying to) to do everything about your H1, Labor substituion, GC etc.

Go read the posts on the other website, and you will see how important it was to counter this guy's posts that were raising basic doubts about IV.
To have prompt responses is extremely important! If you brush aside negative comments from 'male buffalos' and not counter them - we will never be able to get them into action!
Anyway, however clumsy my efforts, I could not just sit and watch & not try to get doubts addressed.

Here are my two cents to keep yourself calm, composed and dignified
1) Empathy will win friends and support
2) Sympathy you will have only when someone is humble and meek
3) If you lack both the society will ignore you

If you really looking for long term solution then you should focus on action items that core members asking us to do...Have you done any of these?
members will file 485 whenever they can and whenever they want to. I don't think even single person should buy this idea.

Most of us are concerned about short term goal of getting the application to uscis as quickly as possible , but think of the end result of whether your application be accepted if we rush, the uscis can come back and reject at any time from any date as it happened to Eb3-other workers. In any case there is a very good chance that your wife will kill u ;)

We just received news that the Judiciary Committee hearings which were supposed to run until 1.00 pm today and also tomorrow have been postponed to March 27th. Apparently the deal is that the Judiciary Committee wants to put pressure on Senator Frist so that he does not introduce his version of the bill bypassing the committee...

everyone here on the call has historical record, honest to god. i have a good news, we r standing up for ourself, to tell this story of bypassing the american talent, and that’s what brighfuture jobs is about. that’s what durbin bill will do for us. there are couple of people who will focus on foreign citizens. two things (1.) they will hear from us, and (2.) whether we need guest workers at all, will be taken by afl-cio will pick up. but what we will do, we have absolute unique role to play, we will explain how the culture the bypass impacts us, and the culture of exploitation impacts us. we r the only once in the country who can tell this. there is going to be a discussion in beltway about “whether”, but american worker and american it professionals

I found this site useful so I joined in here, but since they did not have India in the listing I added Calfornia. I have a F2B immigration visa pending filed by my parents in the US. I had interview in Chennai, India on Sep 2007. I fell short of some docs and submitted those on 28 Dec 2007 and was given 221g and told my case will be held up due to administrative processing.
I wanted to know if this new name check ruling helps me in any way. Also how long more should I expect to wait for the visa.

What do you mean? My father was an engineer and he started his Bachelor of law at age 58 in 1996 in India, after retirement. regular college, which only 10% pass out off.

The first thing you should understand are most of these conversions are started by foreign organizations and their followers, and conversions by force or by paying money should be stopped immediately.
Well some general knowledge for you - I haven't heard of native roman catholics converting anyone. They are very conservative and it is very difficult religion to follow - numbers don't matter.
What propaganda is this? The american overseas pursuits are not related to religion.
There are some rogue organizations here, who run this as a business, with profit/loss, and they need to be monitored in India. They surely have branches there too.

Its just that we have not yet reached everyone in the community yet. Everyone reading this message, please make sure to pass on the rally information to at least one person you know, this weekend. Then ask that person to pass it on further.
Let us use all our networking to best use here. 10K is not a difficult number. When we started this organization, we could not even get 10 people together, but nobody gave up hope.
The success of the rally, this cause and our own greencard issues depends on each one of us. I'm sure we are all capable of sharing this responsibility.
