The AILA memo says this:
We have been informed that USCIS HQ has instructed the NSC and TSC to reject employment based I-485 applications in the third preference �Other Workers� based on a memo sent by the DOS�s VO to USCIS advising that as of June 6, 2007, there would be no further authorization of visa numbers in this category.
According to this the VO or VCO can advise CIS to stop asking for numbers.
Is this a violation of the law?
Of course not.
AILA is trying to establish a precedent by saying that only the VB is the one that should determine the visa availabulity.

EB3 2001. H1B valid till Oct 2008.
Booked tickets (4) - to travel on Jun 6th - 3 months ago. didn't expect dates will move.
Now, I know when filing is done on Jun 1 ( attorney said), we have to be in US.
Q1: Do we have to wait for receipt to be received by attorney and /or me?
Q2: From filing date, how long it will take to get the receipt? One day, two days , one week or two weeks or more.

My lawyer says that if you apply for EAD and AP at the same time then you need to remain in the country until these come through. As for 485, the only issue is FP notice. Note the letter is addressed to chertoff. So even if USCIS do not send all those documents, Chertoff will kick the butt of USCIS to "get the damn thing fixed" before it becomes a bigger issue.

He said his amendment was an appropriate addition to that particular measure � legislation designed to increase the wages of working Americans � because the salaries of low-skilled workers have lagged behind due to the large influx of illegal aliens.
Although Democratic leaders refused to let Sen. Sessions' initial amendment reach the Senate floor, a second Sessions proposal was adopted that day by a 94-0 vote. It would prohibit any government contractor caught using illegal labor from future government contracts for ten years. It is expected to face serious opposition by business and union lobbyists when the bill reaches conference committee.
Sen. Saxby Chambliss (R-GA) also introduced and withdrew a positive amendment that would have required that the employers of temporary unskilled foreign agricultural workers (H-2As) pay the greater of either the Federal minimum wage or a newly defined prevailing wage.

I hold a H4 visa and my employer had applied for my H4 to H1 conversion in this cap. i have not yet got any receipt number from the USCIS. My question is that if I get the approval notice itself I will be able to work or I should wait till Oct 2007?

I agree, this is the way politics works most of the time. lobby for votes, etc.
But isn't it also their job to do what is in the best interest of the Nation. Everything isn't decided by lobbies.
Maybe we're approaching this the wrong way, in trying to build competing lobby. it needs a new approach. Congress should be convinced in a different way.
Lobby is for optional, nice to have things, which will not be generally missed if they fail.
Legal immigration is none of these and is almost mandatory. Imagine losing for eg. 200K EB3s. another 50K doctors.

Be concerned and be VERY CONCERNED. Being in denial will not help. Work with the assumption that the dates might go back any time. If your conditions does not permit you to file in the first week there is not much you can do. Tough luck if the dates go back. But if there are things you can do , please do...
I will give you an example, It is very difficult to get medical appointments where I live and the first opportunity was July last week. I traveled 120 miles (not much) and got mine done last week, where as a friend of mine did not want travel and took the local appointment for Jul 3rd week assuming he can file by Jul31. With the change in dynamics he has to revise the plans and may not get the appointment 120 miles away.
I mean to say, work with the goal to apply ASAP.

Great Going needhelp. Dont worry about your speed for now. We will gradually work towards walking more distance and get to 2.5 miles in a few weeks. We can do it.
I did 3.5 miles at lunch. it was 77 degrees outside. so 3 miles of running and 0.5 mile of walking took 36 minutes and a litre of water..had to stay hydrated..Hopefully next time I do it I wont need as many water breaks.
and I completed 10 rounds probably 1.5 miles.. So you know I was going rrreeeaaaally slow. (but it was good enough for me)

My labor certification (Traditional EB-3) is stuck in BEC since last 5 years. It is completely beyond my understanding why it took so long for BEC to process my case. Now everyone is rejoicing USCIS's decision to accept all green card applications, but I am paralyzed with the fear of facing another huge backlog on I-485 applications. One government agency sits on our applications for years and another government agency throws us further back in the line to cover up its blunders and guess what who pays the price: WE RULE-ABIDING, LINE-WAITING FOLKS.
Even if I get my labor approval before September, I will be among the last persons to get labor certification in spite of being the one with the earliest priority date. Nothing would give me greater pleasure than suing DOL BEC at this time. We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on their web site that they have tried to maintain FIFO, it makes me feel like puking.
I am also disappointed with IV's attitude towards the backlog victims. I do not remember anything concrete done by IV to address the grievances of backlog victims. Now that they have won the battle with USCIS, will they have time to look at us?

did they give the letter to you , it might have been possible that either they did'nt receive the letter completely or they might be with-holding information from you

In my birth certificate, the name given is different than that used in my school records and passport. I have a laminated photo copy of the gazette record that confirms the fact that my birth certificate name has been changed to the name I have in the school records and passport.
Also, the municipality will not issue me a Not Available certificate since they already have one but with a different name.
Has anybody been thru a similar situation, if so, will the gazette record of the name change and the original birth cert( with a diff. name) be used as valid biographic documents.
Any help is deeply appreciated.

I have an approved labor cert thru PERM(PD: July 2006). The advertisements were made in May.
I also have a pending TR case in DBEC(PD: Aug 2002). I'm planning to have it converted to RIR. Would anyone know if I can use the same advertisement efforts that were used in the PERM case, as basis for the TR to RIR conversion?

This rumor from fragomen's site is creating a havoc everywhere.
These rumors are wreaking havoc on people who are not in a perfect position to control the timing of filing. Many lawyers and many employers will file between 25th and 31st July. And I can accept that. My own HR and lawfirm have made it clear that we will file before 31st July but there is no guarantee that it will be sooner than that and any sooner than that is not neccesary.
Those who are filing on their own can file on July 1st. But those who are depending on lawyers and their own HR, please relax and stop thinking too much.
Never trust the FDBL assholes. They've screwed me multiple times in the past and the irony is that I've paid them for that.
